SERVICE CONDITIONS
1. What is the AECC?
Pursuant to article 10 of Law 34/2002 regarding Electronic Retail and Information Society Services (hereinafter “Law 34/2002”), please be aware that the domain namewww.aedecc.com, which contains covers our business and our Digital Directory, corresponds to the SPANISH ASSOCIATION OF SHOPPING CENTRES AND RETAIL PARKS (hereinafter the “AECC”), an Association registered in Madrid (C.P. 28046), Calle Mauricio Legendre, núm. 19, 1º A, with tax ID G-78922275, and registered through a resolution dated 10 October 2002 in the Ministry of the Interior’s National Associations Register under number 38,507 and the Madrid Provincial Register under number 4,207.
Furthermore, and in order to respond to queries, we provide a User Service Desk which can be contacted between 8am and 3pm, Monday to Friday excluding bank holidays through the following channels:

2. Content of the Service Conditions
2.1 Purpose and Acceptance of the Service Conditions
The Service Conditions of the AECC Digital Directory linked to the domain name www.aedecc.com aims to comply with the information obligation contained in art. 10 of Law 34/2002 which is imposed on all service providers, as well as establishing the rules of use of the abovementioned Digital Directory which are applicable to its users as a result of its use, regularising the services that the AECC provides to the user (hereinafter the “User”) through the Digital Directory.
The access, use and acquisition of the Digital Directory is understood as acceptance by the User of this entire document, requiring them to comply with its terms and conditions, as well as the Privacy Policy.
The AECC informs you that in order for the User to participate in the services offered in the Digital Directory, they must register - following the guidelines that are provided for this purpose during the process-: as a contact (hereinafter also the “Contact”), or as a recipient of AECC newsletters (hereinafter “Newsletter Recipient”). The abovementioned services, as well as general use is governed by these Service Conditions, the Privacy Policy and the terms and conditions which the User must accept prior to registration as a Contact or Newsletter Recipient (hereinafter “General Conditions of Use and Contracting”).
2.2 General Conditions of Use and Contracting
These General Conditions of Use and Contracting aim to regulate the provision of information supplied in the AECC Digital Directory as well as the regulation of services that the AECC provides in the Digital Directory.
Pursuant to Organic Law 15/1999 of 13 December regarding Personal Data Protection, as well as Royal Decree 1720/2007 of 21 December, which approves the Regulation that implements it, it is forbidden for children under 14 years old to access or use the Digital Directory without the express consent of their parents, without holding the AECC liable for the accuracy or truthfulness of the data provided by the User.
Below are the conditions which will govern the contracting of products and/or services through the web page. The acceptance of these conditions implies that the User:
These conditions are applicable indefinitely and will be applicable to all contracts created through the Digital Directory.
The AECC web page can be accessed for free, except for the connection cost through the telecommunications network provided by the access provider which is entered into by the User. Furthermore, access to the Digital Directory can only be through a subscription.
The User agrees to make diligent and confidential use of the Digital Directory, they will not use it for fraudulent purposes and they cannot do anything which could damage the image, interests and rights of the AECC or third parties. For these purposes, the User will not, including but not limited to: (i) get involved in illicit or illegal activities or activities contrary to good faith and public order; (ii) distribute racist, xenophobic, pornographic, terrorist or anti-human rights content or propaganda; (iii) cause damage to the hardware and software systems of the AECC, its suppliers or third parties, introduce or distribute viruses to the network or any other hardware and software system which are likely to cause damage; (iv) try to access and, where appropriate, use the email accounts of other users and modify or manipulate their messages. The User will also not carry out any activity to damage, disable or overload the web page, or which impedes or prevents normal operation in any way. This liability is extended to the registration which is required to access certain services or content.
The AECC will not be responsible for the use by third parties of information published on the portal, or the damage suffered or financial losses which, directly or indirectly, cause or which can cause financial, material or data damage due to the use of this information.
If the User does not comply with the Service Conditions, the Privacy Policy or the General Conditions of Use and Contracting or any other specific terms and conditions contained in the Digital Directory, the AECC reserves the right to limit, suspend, terminate etc. their use, adopting any technical measure required for this purpose. If the AECC reasonably believes that the User is not complying with any of the terms contained in the abovementioned documents, the AECC can apply these measures.
Furthermore, the AECC can, at its own discretion, decide on service continuity which, at all times, is provided through the Digital Directory or the modification of the conditions determined herein, in which case the modifications will be published - indicating the date from when they are effective - so that the User is aware.
Pursuant to section 2.1 “Purpose and Acceptance of the Service Conditions”, the AECC provides the User with a series of publications so that they can, if desired, acquire them through the sales process described in the Digital Directory. The AECC reserves the right to modify the offer of these publications, their prices, and other contractual conditions which apply.
If any error arises in the information provided on this page, the AECC will immediately correct it. And if the error affects the prices shown on the Digital Directory web site, and any User had made a purchase decision based on this error, they will be informed as soon as possible and they will have the right to cancel their purchase at no cost.
The contractual information, the communications sent to users and the contracts which are entered into to acquire the publications will be written in Spanish.
The prices which are featured on the Digital Directory web site include applicable taxes (VAT).
Approval of the order by the User implies express acceptance of these General Conditions of Use and Contracting. Once the purchase is made, and as soon as possible (in all cases within 24 hours following the order), the AECC will send an email with acknowledgement of the purchase. If the details are incorrect, a request can be made to modify or cancel the order, also by email within 24 hours following receipt of the acknowledgement of purchase.
Selecting the subscription type, the subscription payment will be made through the AECC website payment system (www.aedecc.com) which, through the Digital Directory “check list” will give direct access to the AECC web page payment gateway, where the user can pay for their subscription.
2.2 Intellectual and Industrial Property
The content published on the Digital Directory and especially the designs, text, graphics, logos, icons as well as software, brands or trade names, and any other symbols used for industrial and trade purposes, are protected by the corresponding intellectual and industrial property rights of AECC.
All rights reserved. Pursuant to articles 8 and 32.1, second paragraph of the Intellectual Property Law, it is expressly prohibited to reproduce, distribute and publicly communicate, including how it is provided, all or part of the content of this web page, for commercial purposes, in any material or technical medium, without the prior written permission of AECC. The User agrees to comply with the Intellectual and Industrial Property rights held by the AECC.
The User can view the portal elements and even print, copy or store them on the hard drive of their computer or any other physical medium as long as solely and exclusively for their personal and private use. The User must not delete, alter, bypass or manipulate any security system or protection system which is used on the AECC web page.
Under no circumstances will it be assumed that any licence is awarded or any rights renounced, transmitted or transferred totally or partially without the prior express written authorisation of the AECC or people linked with it, where appropriate.
2.3 Links policy
It is prohibited to create links towards this web site apart from those which have been previously authorised by AECC; they must comply with the terms and conditions set forth at all times.
The AECC is not responsible for the legality of other web sites from which the portal can be accessed. The AECC also does not comment on the legality of other third party web sites, which can be linked to this portal.
If the portal provides links or hyperlinks to other web sites, the AECC will not hold any control over these sites and content. Under no circumstances will the AECC assume responsibility for the content of any link belonging to an external web site, nor will it guarantee the technical availability, quality, reliability, accuracy, extent, truth, validity and constitutionality of any material or information contained on these hyperlinks or other websites. Also, the inclusion of these external links does not imply any sort of association, merger or participation with the connected entities.
2.4 AECC responsibility
The User recognises and accepts that the content of this web page is general and solely informative.
The AECC is not made responsible for any damage which could occur due to interruptions, viruses, breakdowns and/or outages in the operation of the web site or the users’ devices, caused by reasons not attributable to the AECC which impede or delay provision of the services or browsing on the website, due to reasons attributable to the User, third parties, or due to acts of God or force majeure.
The AECC reserves the right to make changes to its web site without prior warning, in order to keep its information updated, introducing, deleting, modifying or correcting the content published or the portal design.
3 Privacy Policy
The aspects relating to processing of personal User data are contained in the Privacy Policy.
JURISDICTION AND APPLICABLE LAW
These Service Conditions, as well as the Privacy Policy and the General Conditions of Use and Contracting, are governed by Spanish law.
The AECC and the User are expressly subject to the jurisdiction and scope of the legal authorities of Madrid, expressly renouncing any jurisdiction which could apply, for any legal matter which could arise from the interpretation, compliance or execution of the Service Conditions, Privacy Policy and General Conditions of Use and Contracting.
These General Conditions of Use and Contracting are up-to-date as of 8 July 2016.
